Bismillah was shalatu was salamu ‘ala rasulillah, amma ba’du,

Zina termasuk salah dosa besar dalam islam. Karena itu, dosa zina mendapatkan hukuman khusus di dunia. Cambuk 100 kali bagi pezina yang belum menikah (ghairu Muhshon), dan rajam bagi pezina Muhshon (yang sudah menikah).

Lebih dari itu, setiap orang yang melakukan perbuatan dosa, dia diwajibkan untuk bertaubat. Dan cara yang diajarkan oleh islam untuk menghapus dosa besar adalah dengan bertaubat. Allah berfirman,

إِنْ تَجْتَنِبُوا كَبَائِرَ مَا تُنْهَوْنَ عَنْهُ نُكَفِّرْ عَنْكُمْ سَيِّئَاتِكُمْ وَنُدْخِلْكُمْ مُدْخَلًا كَرِيمًا
Jika kamu menjauhi dosa-dosa besar di antara dosa-dosa yang dilarang kamu mengerjakannya, niscaya Kami hapus kesalahan-kesalahanmu (dosa-dosamu yang kecil) dan Kami masukkan kamu ke tempat yang mulia (surga). (QS. An-Nisa: 31).

Ayat ini menjelaskan, syarat dihapuskannya kesalahan adalah bertaubat, dengan meninggalkan dosa yang dilakukan.

Taubat secara bahasa artinya kembali. Orang yang bertaubat, berarti dia kembali dari kemaksiatan, menuju aturan Allah, diiringi memohon ampun kepada-Nya.

Rukun Utama Taubat Ada 3:
An-Nawawi mengatakan,

وقد سبق في كتاب الإيمان أن لها ثلاثة أركان: الإقلاع، والندم على فعل تلك المعصية، والعزم على أن لا يعود اليها أبدا
”Dalam kitab al-Iman disebutkan bahwa taubat memiliki 3 rukun: al-Iqla’ (meninggalkan dosa tersebut), an-Nadm (menyesali) perbuatan maksiat tersebut, dan al-Azm (bertekad) untuk tidak mengulangi dosa yang dia taubati

selamanya. (Syarh Shahih Muslim, 17/59)
Berikut penjelasan lebih rincinya,

Pertama, al-Iqla’ (Meninggalkan dosa yang ditaubati).
Inilah bukti keseriusan taubatnya. Meninggalkan dosa yang dia lakukan. Seorang pegawai bank, belum dikatakan bertaubat dari riba, selama dia masih aktif kerja di bank. Seorang pezina belum dikatakan bertaubat dari zina, sementara dia masih rajin berzina.
Imam Fudhail bin Iyadh menyatakan:

“Istighfar tanpa meninggalkan kemaksiatan adalah taubat para pendusta.”

Kedua, an-Nadm (Mengakui kesalahan dan menyesali perbuatannya)
Orang yang tidak mengakui dosanya, dia tidak akan menyesali perbuatannya. Dengan menyesal, dia akan bersedih jika teringat dosanya. Termasuk bagian dari penyesalan itu adalah tidak menceritakan dosa tersebut kepada orang lain, apalagi membanggakannya. Dan jika dosa itu dipicu karena komunitas dan lingkungan, dia akan meninggalkan lingkungan komunitasnya.
Bentuk penyesalan pezina adalah dengan menghindari segala yang bisa memicu syahwatnya.



Ketiga, al-Azm (Bertekad untuk tidak mengulangi dosanya)
Jika seseorang berhenti dari dosanya, sementara dia masih punya harapan untuk melakukannya jika waktu memungkinkan, maka dia belum disebut taubat.
Seseorang yang bertaubat dari pacaran ketika ramadhan, dan akan kembali pacaran usai ramadhan, belum disebut bertaubat.

Apakah dengan menikah, dosa zina otomatis hilang?
Dosa zina sebagaimana dosa besar lainnya, hanya bisa hilang dengan taubat. Dan syarat taubat adalah tiga seperti yang disebutkan di atas.
Karena itu, semata-mata menikah, belum menghapus dosa zina yang pernah dilakukan. Karena menikah, bukan syarat taubat itu sendiri. Kecuali jika pernikahan ini dilangsungkan atas dasar:

1. Menyesali dosa zina yang telah dilakukan
2. Agar tidak mengulang kembali dosa zina tersebut.
Jika menikah atas motivasi ini, insyaaAllah status pernikahannya bagian dari taubat untuk perbuatan zina itu.
Untuk itu, sebagian ulama menyarankan agar orang yang melakukan zina, untuk segera menikah, dalam rangka menutupi aib keduanya. Karena jika mereka berpisah, akan sangat merugikan pihak wanita, karena tidak ada lelaki yang bangga memiliki istri yang pernah dinodai orang lain secara tidak halal.
